Terms & Conditions

Choosing a horse photographer is not just about finding someone with a camera. It is about choosing someone who understands horses, understands people, and understands just how much this relationship means to you.

These Terms & Conditions apply to portrait sessions, artwork orders, digital files and other products purchased from Emma Campbell Photography / Emma Campbell Horse Portrait Photographer / Emma Campbell Horse and Dog Portrait Photographer.

By booking a session, accepting a gifted session, completing a booking form, paying an invoice, approving an order or purchasing products, you agree to these Terms & Conditions.

Definitions

In these Terms & Conditions:

“Business” means Emma Campbell Photography / Emma Campbell Horse Portrait Photographer / Emma Campbell Horse and Dog Portrait Photographer.
“Client” means the person or persons booking the session, purchasing products or entering into the agreement.
“Photographer” means Emma Campbell.
“Session” means the portrait photoshoot booked by the Client.
“Booking Form” means the form, contract or online booking details completed by the Client.
“Products” means any wall art, albums, framed portraits, fine art prints, mounted prints, canvases, digital files or other items ordered by the Client.
“Services” means the photography, editing, viewing consultation, design consultation and any other services agreed between the Client and the Photographer.

These Terms & Conditions, together with the Booking Form and any written agreement between the parties, form the full agreement between the Client and the Business.

Any changes to the agreement must be confirmed in writing.

Session Fee and Booking

Your session is only confirmed once the required session fee, booking fee or agreed payment has been received in cleared funds.

The session fee covers the portrait session experience and the time, planning and preparation involved. Unless otherwise stated in writing, wall art, albums, framed portraits, fine art prints, digital files and other products are purchased separately after the session.

Session fees are non-refundable in the event of cancellation by the Client. However, where possible, I will do my best to rearrange your session for an alternative date, subject to availability.

Rescheduling, Weather and Outdoor Sessions

All sessions take place outdoors and may involve horses, dogs or other animals. Suitable weather, light and safe conditions are therefore important.

The Photographer will use her judgement and experience to decide whether conditions are suitable for the session to go ahead.

If the weather, light, location, animal welfare, safety or other circumstances make the session unsuitable, the session may be rearranged for the next available suitable date.

If the Client needs to rearrange, as much notice as possible should be given. Alternative dates are subject to availability.

Animal Welfare and Safety

The welfare of the animals involved is always a priority.

The Client is responsible for ensuring that any horse, dog or animal taking part is fit, safe and suitable to be photographed. The Client must inform the Photographer in advance of any injuries, illness, behavioural concerns, nervousness, reactivity, mobility issues or anything else that may affect the session.

The Client acknowledges that working with horses and animals carries inherent risks. The Client and any participants attend the session at their own risk and are responsible for the safe handling, control and behaviour of their own animals.

Emma Campbell Photography will take reasonable care during the session, but cannot be held responsible for injury, loss, damage or expense arising from the behaviour, handling or unpredictability of animals, except where caused by the proven negligence of the Photographer.

The Photographer reserves the right to pause, adapt or stop the session if there are concerns about safety, animal welfare, behaviour, abuse, or the wellbeing of any person or animal involved.

Conduct

The Client is responsible for ensuring the cooperative and safe behaviour of all participants, helpers and animals during the session.

If the Photographer feels unsafe, is subject to abusive behaviour, or witnesses any behaviour towards an animal that she considers unacceptable, the Photographer has the right to end the session and leave without refund or further liability.

Artistic Licence and Coverage

The Photographer shall be granted artistic licence in relation to the images created, poses, locations, lighting, composition, editing and final selection of images.

Although every effort will be made to take account of the Client’s wishes, the Photographer’s professional judgement regarding location, timing, posing, light, editing style and number of images taken shall be deemed correct.

The Photographer cannot guarantee specific images, expressions, poses, behaviour, weather conditions or results, particularly when working with animals.

Where access to locations is restricted, or where subjects, animals, helpers or conditions are unavailable or unsuitable, the Photographer cannot be held responsible for limited coverage.

Viewing and Design Consultation

After the session, images will be carefully selected, edited and prepared for the Client’s private viewing and design consultation.

During the consultation, the Client will be guided through available artwork, album, print and digital collection options.

All orders will be placed and paid for during the viewing and design consultation. These orders will be bespoke and made specifically for the Client.

Retouching and Editing

The Photographer will apply professional editing, retouching and artistic finishing to selected images before the viewing and design consultation.

The Photographer’s editing style is part of the artistic service provided.

If the Client requests additional retouching, manipulation or editing after the viewing consultation, an additional charge may apply. Any additional costs will be confirmed before further work is carried out.

Artwork and Product Orders

All wall art, albums, framed portraits, fine art prints, mounted prints, canvases, acrylics, metal prints, treasure boxes, digital files and other products are ordered to the Client’s chosen images, sizes, finishes and specifications.

Please check all order details carefully before confirming your order.

Once an artwork or product order has been confirmed and placed into production, it cannot usually be changed, cancelled or refunded unless the product is faulty, damaged or significantly not as described.

All products remain the property of Emma Campbell Photography until full payment has been received in cleared funds or an approved PayItMonthly agreement is in place, where applicable.

Bespoke Artwork, Cancellations and Returns

All finished artwork and printed products are bespoke, personalised and made to order.

Under the UK Consumer Contracts Regulations, bespoke or clearly personalised goods are exempt from the standard 14-day cooling-off cancellation period. This means that once your custom artwork order has been confirmed and placed into production, you cannot cancel or return it simply because you have changed your mind.

Sales of bespoke artwork are therefore generally final

This does not affect your statutory rights. If your artwork arrives damaged, faulty or significantly not as described, please contact me as soon as possible so I can put this right.

Damaged, Faulty or Incorrect Artwork

If your artwork arrives damaged, faulty or significantly not as described, please contact Emma Campbell Photography as soon as possible, ideally within 48 hours of delivery and no later than 14 days after receiving your order.

Please provide:

  • Clear photographs of the damage or fault
  • Photographs of the outer packaging
  • Photographs of any internal packaging
  • A clear description of the issue

Please keep all original packaging until the issue has been resolved, as this may be required by the print lab or courier.

If the item is confirmed to be damaged, faulty or significantly not as described, Emma Campbell Photography will arrange a replacement, repair or refund, depending on the circumstances.

Where a return is required due to a confirmed fault, damage or error, Emma Campbell Photography will be responsible for reasonable return shipping costs or will arrange collection where appropriate.

Digital Files

Digital files, once supplied, cannot be returned.

Due to the nature of digital products, digital file purchases are final once the files have been delivered or made available for download.

Digital files are supplied for personal use only, unless otherwise agreed in writing. Copyright remains with Emma Campbell Photography.

Image Reproduction, Colour and Cropping

All print and product sizes quoted are approximate and may be subject to slight variation.

Every effort is made to ensure products are created to a high standard, but exact colour matching cannot be guaranteed. Images viewed on phones, tablets, laptops or computer screens may appear different due to differences in monitors, screens and device settings.

Cropping may vary depending on the size, shape and format of the chosen artwork.

Payments

Your session fee is required upfront to secure your portrait session.

Artwork, albums, prints, wall art, digital files and other products are paid for at the point of order, unless an agreed payment option has been arranged.

No photographs, wall art, albums, prints, digital files or other products will be ordered, released or delivered until payment has been received in full in cleared funds, or until the Client has been accepted by PayItMonthly where applicable.

Where payment is to be made by a third party, the Client remains responsible for any balance outstanding.

0% Payment Options

Emma Campbell Photography may offer payment options to help Clients spread the cost of their artwork.

PayItMonthly

A 0% interest-free repayment plan may be available through PayItMonthly, subject to application, approval and credit check.

Where a PayItMonthly agreement is approved, the terms of that agreement will be between the Client and PayItMonthly. Emma Campbell Photography is not responsible for the approval or refusal of any finance application.

Artwork may be released once the required deposit and approved PayItMonthly agreement are in place, subject to the specific terms agreed at the time of purchase.

PayItMonthly terms: PayItMonthly is a form of credit that allows you to spread the cost of your purchase over monthly instalments. You must be 18 or over, a UK resident (excluding the Channel Islands), and meet our eligibility criteria. All credit is subject to status and affordability checks. Late or missed payments could impact your ability to access credit in the future. PayltMonthly is deemed authorised and regulated by the Financial Conduct Authority for the purposes of the Temporary Permissions Regime for Regulated Deferred Payment Credit. Details of the Temporary Permissions Regime, which allows firms to carry on deferred payment credit activities while seeking full authorisation, are available on the Financial Conduct Authority’s website. Studio Payment Plan

Emma Campbell Photography may also offer an in-house 0% studio payment plan.

With this option, the Client may spread the cost of chosen artwork over an agreed or flexible period. No interest is charged.

Artwork, albums, prints, digital files or other products will only be ordered, released or delivered once the full balance has been paid.

Payments made towards an in-house payment plan are part-payments towards a bespoke order and are not normally refundable once production has begun or the order has been confirmed, unless the item is faulty, damaged or significantly not as described.

Reorders

All reorders are treated as an extension of the original order.

Reorders must be provided in writing. No responsibility for errors can be accepted unless the order details were confirmed in writing.

Product availability may change over time. If a product is no longer available, a suitable alternative of similar quality will be offered where possible.

Copyright and Ownership

Copyright of all images remains with Emma Campbell Photography at all times, in accordance with the Copyright, Designs and Patents Act 1988.

Images may not be copied, scanned, screenshotted, edited, filtered, printed, reproduced, sold, entered into competitions, used commercially or supplied to third parties without written permission from Emma Campbell Photography.

Where digital files are purchased, they are supplied with a personal-use licence, allowing the Client to print and share them for personal use only, unless otherwise agreed in writing.

Image Use and Client Permissions

Emma Campbell Photography may ask Clients to complete a GDPR consent form, model release or image permission form.

Where permission is given, selected images may be used for portfolio, website, social media, printed literature, advertising, PR, awards, exhibitions, training, talks or other promotional purposes.

The Client may withdraw consent for future use of images at any time by contacting Emma Campbell Photography in writing. This will not usually affect materials already printed, published, submitted or distributed before consent was withdrawn.

Data Protection

Personal information will only be used for purposes relating to enquiries, bookings, sessions, orders, delivery, payment and client communication.

Personal details will not be sold or shared unnecessarily with third parties. Information may be shared with trusted suppliers only where required to fulfil an order, such as professional print labs, couriers or payment providers.

Substitution

In the unlikely event that Emma Campbell is unable to attend a session due to illness, emergency or circumstances beyond her control, the session may be rearranged.

Where appropriate and agreed, Emma Campbell Photography may appoint another suitable photographer to attend on her behalf.

Insurance and Limitation of Liability

Emma Campbell Photography maintains Public Liability and Professional Indemnity insurance.

In the unlikely event of photographic failure, technical failure, cancellation or any other issue, liability shall be limited to the total amount paid by the Client under the relevant agreement.

Emma Campbell Photography shall not be liable for indirect or consequential loss.

Force Majeure

The performance of this agreement is subject to alteration or cancellation due to events beyond reasonable control. These may include, but are not limited to, extreme weather, illness, accident, fire, flood, storm, civil unrest, travel disruption, national emergency, terrorism, failure of energy sources, supplier failure or other circumstances beyond the control of either party.

Complaints

Any complaint should be raised by the Client directly to Emma Campbell Photography in writing within 14 days of the issue arising.

Emma Campbell Photography will consider the complaint and aim to respond within 14 days of receipt.

In the unlikely event of an unresolved complaint, the Client may request The Guild of Photographers to mediate, where applicable, on the basis that its decision shall be final and binding upon both parties.

Governing Law and Jurisdiction

These Terms & Conditions shall be governed and interpreted in accordance with the law of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
